Dutch employment law for employees
Received a Dutch settlement agreement? Have it reviewed before you sign
A Dutch settlement agreement can affect your salary, severance, notice period, unemployment benefits and post-employment restrictions. We review the complete proposal and explain the practical options in English.
Six-step review
Know what you are agreeing to before employment ends
Do not assess the severance payment in isolation. The end date, salary, leave, bonus, equity, restrictions, final discharge and benefit risks should be considered together.
Do not sign yet
Note the deadline and have the entire agreement reviewed first.
Collect the key documents
Have the agreement, employment contract, recent payslip, relevant plans and correspondence available.
Calculate the full financial position
Consider salary, leave, bonus, equity, pension, garden leave and legal fees in addition to severance.
Check benefit risks
Review the initiative, termination reason, end date, notice period and any sickness. Unemployment benefits cannot be guaranteed.
Negotiate where appropriate
Identify which financial and non-financial terms can realistically be improved.
Sign only after a final review
Check the final wording, annexes, final discharge and the statutory cooling-off clause.
What do we review?
- Initiative, termination reason, notice period and end date
- Salary, statutory transition payment and additional severance
- Garden leave, unused leave, bonus, commission and equity
- Pension, insurance, study costs and company property
- Non-compete, non-solicitation, confidentiality and penalties
- Reference, communications, legal fees and final discharge
- Cooling-off period and possible benefit consequences
Legal fees
Many Dutch settlement-agreement proposals include a contribution towards legal fees. Whether it is sufficient depends on the agreement and the support required. We confirm the scope and fees in writing before carrying out additional work.
Are you currently sick?
Ending employment during sickness can affect continued salary, reintegration obligations and benefit rights. Do not sign a settlement agreement during sickness without first obtaining advice on those consequences.
Questions and answers
Dutch settlement agreement FAQ for employees
Do I have to sign the settlement agreement immediately?
No. Note the response deadline, but have the full agreement and your legal position reviewed first. You can ask your employer for reasonable time to obtain legal advice.
Can a Dutch settlement agreement affect unemployment benefits?
Yes. The initiative, reason for termination, end date and applicable notice period can all matter. UWV makes the final benefits decision, so no agreement can guarantee eligibility.
Which end date and notice period should be used?
That depends on your employment contract, Dutch law and sometimes a collective labour agreement. An end date that is too early may create a gap without salary or unemployment benefits.
Is the proposed severance payment reasonable?
This depends on the employer's file, length of service, salary components, other entitlements and your negotiating position. The statutory transition payment is often a reference point, but not necessarily the final outcome.
Can I negotiate a Dutch settlement agreement?
Yes. Negotiations may cover compensation, end date, garden leave, legal fees, restrictive covenants, reference wording, communications and final discharge. The realistic scope depends on the underlying facts.
Will my employer pay my legal fees?
Many Dutch settlement-agreement proposals include a contribution towards legal fees. Whether it is sufficient depends on the agreement and the support required. We confirm the scope and fees in writing before carrying out additional work.
What happens to unused leave, bonus and shares?
The agreement should address unused leave, holiday allowance, bonus, commission, equity and other benefits. The relevant plan rules and vesting conditions need to be reviewed separately.
Can a non-compete or non-solicitation clause be removed?
This can be part of the negotiations. The agreement should state clearly whether a restriction is waived, narrowed or remains in force, and should also address confidentiality and penalties.
What does final discharge mean?
Final discharge usually means that both sides waive further claims connected with the employment and its termination. It is important to identify any rights that must be expressly preserved.
Can I withdraw after signing?
An employee can generally withdraw in writing within fourteen days. If the agreement does not mention this statutory right, the period is generally twenty-one days. Exceptions apply, so obtain advice promptly.
